Lawsuit by Commonwealth of Massachusetts and States of Connecticut and Maine with Respect to EPA Regulation of Carbon Dioxide Emissions
In 2003, the states of Massachusetts and Connecticut filed a lawsuit to force the EPA to include CO2 as a pollutant. The purpose was to get the EPA to regulate CO2 emissions. This paper sets out to review the legal and factual allegation made in the lawsuit. It concludes that CO2 does not cause a health hazard. It further concludes that CO2 is a by-product of our civilization, and that its regulation means energy rationing and scarcity.
