The State of California filed this action to challenge the Tuna Canners refusal to comply with Califonia's Proposition 65 warning requirments according to Health & Saftey Code section 25249.5 et seq.  The State argues that the Tuna Canners are required to place a Proposition 65 compliant health warning on defendents tuna cans because of the potential health risks of methymercury in canned tuna.
