Amicus Brief: Deseret Power Electric Cooperative

U.S. EPA issued a Clean Air Act permit last year to the Deseret Power Electric Cooperative, ending a three year process costing the utility millions of dollars. The Sierra Club has asked the EPA’s Environmental Appeals Board to reject this permit because it does not require the utility to control emissions of carbon dioxide.

Carbon dioxide is not regulated under the Clean Air Act currently because EPA has not made a finding that it endangers human health and welfare. Sierra Club and numerous other environmental groups are urging EPA to regulate it even without such a finding.

Heartland’s brief urges the Appeals Board not to deny the permit on carbon dioxide grounds, aubmitting the Nongovernmental International Panel on Climate Change Summary Report, which eviscerates the IPCC Reports and establishes that global warming is not a crisis.
