Martin points to a flurry of classic moves and countermoves made by lawyers. For years, federal judges could impose severe financial sanctions against lawyers and clients for filing frivolous lawsuits, citing standards set by the Federal Rules of Civil Procedure. But a reform movement softened the standards by 1993, paving the way for loosened legal grip on frivolous suits.
